The Canadian Government brings good news to those who couldn’t get citizenship due to the first-generation limit in the 2009 Citizenship Act. On 23rd May 2024, they launched Bill C-71 to make the citizenship process easier and fair for all. The new legislation lets eligible citizens claim Canadian citizenship by descent beyond the first generation. It extends citizenship to those born to a Canadian parent but resides outside of the country through the second and subsequent generations. This blog sheds some light on Bill C-71 in Canadian Citizenship Laws so you can make the most of this opportunity if eligible.

What is the Bill C-71 all About?

Bill C-71 makes the Canadian Citizenship Laws more favourable to the country’s citizens based on their descent.

The government came up with Bill C-71, which serves two purposes:

  • Grant immediate citizenship to all who were devoid of this opportunity solely because of the first-generation limit
  • Extend access to Canadian citizenship beyond the first-generation

Prior to the announcement, the Citizenship Act only let parents transfer citizenship to their first-generation children. Thus, Canadian parents born outside Canada weren’t allowed to transfer citizenship to their child if it was born outside the country. If the Canadian parents adopted a kid from outside the country, they too couldn’t apply for a direct grant of citizenship due to the act.

Keeping the problems in mind, the Ontario Superior Court of Justice gave instructions to the Government to make the amendments to the act. They concluded the act was unconstitutional since it gave rise to two classes of Canadians.

Who are the Lost Canadians?

The Conservative Government of Canada brought forth a new regulation to the Citizenship Act in 2009. The regulation did not allow Canadian citizens born outside of Canada to pass citizenship to their children also born outside the country. Also, parents had to sponsor their second-generation children to enter the country and apply for permanent residence as any other immigrant.

What about the Bill S-245 in Canadian Citizenship?

These are people who lost their Canadian citizenship due to previous legislative changes or specific requirements that they failed to meet.

Key provisions of Bill S-245 include:

This intake will begin on 31st May 2024 and the Government will send about 35,700 invitations in two weeks. Who is a ‘Sponsor’ in Sponsorship Applications?

The sponsor is the one who takes full responsibility for the people they want to support in Canada.

  • Parents and grandparents related to you by birth or profession

  • Current spouse, conjugal or common-law partner of the parents and grandparents if they are divorced

Your parents and grandparents should provide all required complete forms and documents while submitting their application. Additional documents such as biometrics, police certificates and medical exams are also required. 

However, you are not allowed to sponsor your in-laws though you can be a co-signer on their application. Anyone who is not allowed to enter Canada is not eligible for this program.

What are the new changes for international students in BC PNP?

Three New BC PNP Streams

The following new streams will replace the existing International Graduate and International Post-Graduate streams.

The Bachelor’s Stream- Recent graduates with a bachelor’s degree from a legitimate post-secondary institution can apply for this stream. It is also applicable to graduates with an indeterminate full-time job offer.

The Master’s Stream- Recent graduates with a master’s degree from a legitimate post-secondary institution can apply for this stream. It is also applicable to graduates with at least a year of full-time work experience.

The Doctorate Stream- Candidates and graduates of doctoral-level programs from legitimate institutions will be able to apply for this stream. PhD candidates can apply directly.

Does that mean there’s no permanent residency option for students with diploma or certificate programs in Canada?

No, you can still qualify and apply for other BC PNP streams.

Language Requirements

As you know, there are three ways to immigrate to BC via BC PNP. Those are the British Columbia Express Entry Stream, Skills Immigration Stream and Entrepreneur Immigration Stream. The Ministry increased the minimal competence level of language requirements for all of them except the Health Authority Stream. The current minimum Canadian Language Benchmark (CLB) requirement is 8 for the new graduate streams.

When Will The New Streams Be Active?

The three new streams under BC PNP will be launched in January 2025 for international students. While some details will be available in late 2024, you can expect the entire published norms by January 2025.
